I doubt you could prove it to a jury, so no, there is no independent claim against the doctor or wc insurer. If you have RPS, then don't settle your case without a lawyer. Apply for Social Security Disability Benefits if you have been off work at least a year.

You should immediately file a worker's comp claim with the State of Montana if you haven't done so. If you have, follow your doctor's treatment and try to get a full release back to work as soon as you can. You don't need an attorney unless the insurer denies your claim or benefits you think you deserve.

A dismissal means that the Plaintiff has received a settlement or judgment and dismissed the named defendants. It usually means that the defendant paid money or that the plaintiff received some other form of satisfaction and dismissed the case. If the client was represented by an attorney the dismissal doesn't necessarily mean that the client received money or that liens have been paid.
