If my husband was in an accident with life altering injuries and driver at fault is uninsured, what is our best recourse?

If your husband, or someone on his behalf, filed the SR-1 with the California Department of Motor Vehicles (DMV), then you can find out if the parents and/or the driver of the other vehicle had liability insurance. You need to file form SR-19 with DMV. There is a $20 fee. After DMV processes the request, you will be advised if there is insurance. There are also services which locate the existence or non-existence of insurance.

If the company has real workers' compensation insurance, it will be protected from lawsuit in most instances but you will be able to get workers' comp benefits along the way.  If you are not getting benefits yet, then we need to figure out why and pursue what you are owed. If the company does not have workers' compensation insurance, then you can actually sue your company for its negligence in the cause of your injuries.  The difference is that in this type of case you don't get any monetary benefit until after the case settles or goes to trial.

Part of your auto policy obligates your carrier to designate counsel for you in the event that you get sued for the accident. However, need to make sure that you contest the ticket and the officer's finding of fault because if you don't do that and just pay it then they will use that to establish your fault for the accident. Make sure you contact your carrier as soon as you receive service of the complaint from the other party.
