Not malpractice. This was a judgment call. Some children will have difficulties no matter what you do. How much anesthetic is enough? How much is too much? Some teeth are just plain difficult to get out. Tooth fracturing is not uncommon, given that the tooth is bad to begin with which is why it is being removed. It sounds to me that he did the best he could do with a bad situation.
