Back injured in auto accidant pain and suffering

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
The other driver had no choice but to take full responsibility for the accident: there is no excuse for a rear-ender. I have no doubt that his insurance company would like you to settle the pain and suffering portion of the accident. They want your claim to go away on the cheap. Assessment of damages in a personal injury case requires detailed analysis of liability, the injuries, and the effect of those injuries upon the individual. This analysis includes application of legal principles, evidentiary factors, medical documentation, out of pocket expenses, calculation of future losses and experience in the applicable jurisdiction (in this case, Michigan) as to likely range of prospective jury awards. A "cookie-cutter" approach, a standard answer or a formula would be a disservice to someone such as yourself, who needs the help of an experienced personal injury lawyer. To answer the question properly, one would need extensive examination of all the evidence, particularly the medical records. Get in touch with a personal injury lawyer in the area where the accident happened. That is the best way to get the best result in your case.

Can I sue my chiropractor for making a back injury worse?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Personal Injury lawyer at Bulman Law Associates PLLC
Yes, but first you must present your claim to the Chiropractic Panel for their review. Their decision is not binding but mandatory. I don't see a viable case because the costs of pursuing a case are substantial and your current damages are very limited. Proving to a skeptical Montana jury that your current condition was caused by the chiropractor wouldn't be easy. You saw him because you back was already hurting. Trying to apportion pre-existing pain and problems from your current pain and problem based on your statements alone would not be enough, because you are asking a jury to make the doctor pay money for your health problems. Need good proof.
