Is there a possible law suit if I found a dead roach in my salad from restaurant?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
What should you do: Forget it. Is there a possible law suit: no. Here's why: 1) Being grossed out does not constitute an injury. 2) Even including the vomiting and the emotional distress, there are not enough "damages" to make it worth the time and effort involved, including yours. 3) I have no reason to doubt anything you have said, but Olive Garden does, and I would not put it past their insurance carrier to claim that you set this all up (there are people who would do this sort of thing) and how would you prove otherwise?

Can I sue for being served under age and then being assaulted by 11 people?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
Well, if you are smart enough to be in college you ought to be smart enough not to go underage into a bar, get loaded and get in a fight with 11 people. your testimony would likely be of no value because of your alcohol. I assume each of the 11 will have a story different from yours. How do you expect to deal with that?you can sue anyone who assaulted you but people who start fights in bars usually don't have the proverbial pot to pee in and neither they nor the bar can buy any type insurance to cover fights.

Can I file for worker’s compensation if I have not healed from surgery on my back?

You must have already filed for worker's compensation in order to get the surgery. You are probably referring to a "schedule award" which is based on a formula depending on the extent of your disability and your rate of pay, offset by payments you have already received. But: you should get some advice as to whether the schedule award is your best option. Depending on your situation, you may be better off getting disability payments and having your medical expenses taken care of
