What legal actions can I do against hospital maltreatment?

default-avatar
Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
In order to prove a medical malpractice case, a claimant must prove a failure to conform to accepted practice, resulting in an injury. A bad result is not enough. You will need to get copies of all of your medical records and have a doctor review them; if he/she is willing to testify that the hospital failed to conform to accepted practice, then you have a case. But even then, you have to prove how much worse you are as a result of the malpractice. These cases are difficult and expensive to prove and they do not settle out of court. So unless you have catastrophic injuries, it does not make financial sense to go forward even if malpractice was committed.

What can I do to ensure that she doesn't get in trouble, and to get her money back, if possible?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
You should probably call the police and try to press criminal charges against the seller. It could be obtaining goods by false pretenses. I also think there is a specific statute making it a crime to sell a car without transferring title within a certain time. If the police will not bring criminal charges, you can sue the man in small claims court. You may also check the probate court where the lady died to see if her estate was ever probated. If it was, the Personal Representative of the Estate should transfer title to the appropriate person (perhaps the man who sold it to you). If the estate was never probated, you could file probate papers yourself (sometimes creditors of a deceased person File for probate if the heirs will not so that the creditor can file a claim against the estate).

What should I do if my stepdad molested me but mom tells me that if I press charges, my sister will lose her college since he’s a disabled veteran?

Answered by attorney Christian Frederick Paul (Unclaimed Profile)
Personal Injury lawyer at Law Office of Christian F. Paul
Speaking not as a lawyer but as a step dad myself, I am horrified that your stepfather would do such a thing and equally horrified that your mother would help protect him after learning what he did to her daughter for any reason at all. If he molested you, he has molested others and will molest others. Keeping quiet is only going to help him. It won't help you and who knows when he will want to victimize you again? Or your sister? Report him to the police immediately, and get yourself psychological counseling. Find out if he's molested your sister and get her help, too. I don't know how your sister's college money can be affected by this, but on the other side of the equation is lifelong harm to you and everyone else he molests. Which is more important? Courage. Speak up now.
