What can I do if I am being sued for an accident that I couldn't help?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Personal Injury lawyer at Bulman Law Associates PLLC
You are learning the very expensive lesson for what happens to people who drive without insurance. You failed to maintain proper distance and therefore are the most responsible for the collision. At this point, you will be representing yourself. Never fail to answer any court related document you are served or receive in the mail. You can slow the process down. They may give up after they settle the UM coverage your victim has.

I waited 26 days to notify the premise owner of my fall are they still liable?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Personal Injury lawyer at Peters Law, PLLC
The issue is not how long you waited, the issue is was Gold's Gym negligent. Is it the only shop connected to the parking lot or are there other occupants. Does Gold's own the parking lot or is it Gold's landlord? Was Gold's or the landlord negligent in not removing all ice? In States that have a lot of snow and ice, it is not clear that snow and ice has to be completely removed. Call the Idaho State Bar and get a referral. That will give you a better idea of whether you have a case or not.

Am I liable to pay for medical bills incurred from a car accident?

default-avatar
Answered by attorney Donald Keith Broad (Unclaimed Profile)
Personal Injury lawyer at Broad Law Firm, LLC
In Indiana, cases such as this are governed by the Comparative Fault Act which requires that the fault of all involved parties be compared. You would only be liable for whatever percentage of fault is assigned to you. That percentage of her medical bills (any and all medical bills incurred because of the accident) would be your liability.
