First, turn this into our Family Member's Insurance Company. They will hire an attorney to defend the claim. Second, yes, your Family member's next of kin can sue for wrongful death. I do not have enough facts to state an opinion as to whether the other driver would be liable. He/she would not be liable just because h/she was not licensed. Rather, you would have to show that the accident was a result of his/her negligent driving, or put another way, that he/she was at fault. This depends on what witnesses to the accident say (unfortunately, if the family member was driving alone, all of the surviving witnesses may be biased in favor of the other driver, unless there are bystander witnesses) and any observations made by police, such as the position of the car, skid marks, debris in the road, etc.

The statute of limitations in your finance's case is 1 year from the date of discovery of injury that might have been caused by the original performance of the angioplasty. Whether the stent was too small at the time of the procedure is something that would be difficult to prove as being the primary cause of the second heart attack. In addition, in determining whether there was medical malpractice, the records from the initial procedure and the records from the recent procedure including copies of the echocardiogram, EKG and heart catheterization would need to be reviewed to determine the nature and the extent of the damage to his heart caused by the original stent placement. It is always a professional question, what is good dental practice. And if she thought the four would work and the 3 might not, how do you question that? you either trust the woman or you don't "several tears" there is a 3 yr statute of limitations.
