Most likely, you will need to hire an attorney in South Carolina.  Generally, a hotel can be found negligent if the hotel managers and employees knew or should have known about a dangerous condition and failed to take reasonable steps to protect guests from the hazard.   Insect infestation is a known problem in the hotel industry.  If your daughter had a serious injury, she may have a right to sue.

Most people think that the investigating officer is supposed to make a finding of who was at fault in causing an accident, but that is not his job. What the investigating officer is supposed to do is make a determination as to whether one of the operators of the vehicle has violated some Florida law. A citation is issued to the person who the policeman believes violated the law, and that does not always equate to a finding of fault. Whenever a pedestrian is killed in a motor vehicle collision, the person who is driving the car is usually bears some of the responsibility for causing the accident. Only the personal representative of the estate of the decedent can bring a claim for wrongful death, so that person should contact an attorney promptly as there is a two year statute of limitations for wrongful death, and there usually is much investigation that needs to be completed before a lawsuit can be filed.

It is important that you understand that the law does not "penalize" a person for having a pre-existing condition. In fact the law says that the person who causes an accident "takes the plaintiff/victim [you] as they find them." But, the burden is on that victim to show how/if their pre-existing injury was aggravated and/or made them more susceptible to the injury they sustained in a subsequent collision/incident. I have passed our response to a very similar inquiry below (based on the facts I assume this may be a 2nd submission from you): Unfortunately, there is not an easy answer or "formula" to use in calculating what your claim is "worth." There are numerous different factors to consider; the most important of which is related to whether or not your prior injury was aggravated. We don't always suggest that a person needs an attorney to help them when they have been in an accident; however, in light of the significance of your bills, they way in which this has impacted your life and (again, most importantly) your pre-existing condition in your back, we strongly recommend that you consult with an experienced personal injury attorney.
