I disagree with the insurance company's pain and suffering claim offer. Can I ask for a higher offer or consult attorney?

Of course you can always consult an attorney. The insurance company for the other driver will try to "low-ball" you by offering you as little as they can get away with to settle, and they know you have no idea what you are entitled to under the circumstances. Consult an attorney (preferably at least two from different firms) and hire one to represent you. Even after paying your lawyer's fee, you will usually end up settling your case for more than the insurance company would otherwise pay you.

Yes, unless you get someone like a lawyer to help you. Or call the risk management department of the hospital and explain what happened.

Dental malpractice cases are always difficult to prove, as well as expensive and time consuming. You will have to be able to prove a failure to conform to accepted practice, and resulting injury as well, and expert witness testimony is required for that reason. In order to be able to pursue the matter, the consequences would have to be severe enough to merit a substantial enough recovery to justify the time and expense. All that being said, you may have a case here. Round up all the records you can, put together all the information you have especially concerning what happened when, and make an appointment with a lawyer who practices dental malpractice in your locality. Keep in mind, these never go easy no matter how strong your case. It will take at least 2 years to resolve.
