The answer depends. Was he driving on company time, in the course and scope of his employment? Or, was he driving the car on his own time for personal use? There may be some clause in the employment and/or insurance contract which will address this issue. Normally speaking, if the accident happened on company time and while your husband was working (driving on an errand or making a sales call or something like that) the company's insurance should cover the incident.

Call the restaurant and speak with the manager and tell them about your experience. If you think it is a systemic problem with the restaurant, you can let the health department know. You probably don't have a personal injury claim unless your illness required medical attention.
