The insurance company wants me to sign giving them access to all my medical records should I sign?

Audrey Dawn Hayes
Answered by attorney Audrey Dawn Hayes (Unclaimed Profile)
Personal Injury lawyer at A. Dawn Hayes and Associates, P.A.
No, if this is a liability or workers' compensation insurance company because you will be giving them permission to obtain all of your records, whether they are related to your injury or not. You can give them limited permission by indicating that they can obtain records from named medical providers only.

If not at fault for an auto accident . . . should the person not at fault file a claim with his/her insurance carrier?

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
Personal Injury lawyer at Miller & Harrison, LLC
It is absolutely worth consulting a lawyer about this - and it should not cost anything to do so, as if they take the case they likely will offer to do it for a percentage of whatever is recovered.  From what you describe it is definitley worth making a claim against the at fault drivers insurance.

What can I do if I am being sued for an accident that I couldn't help?

Hire a plaintiff contingent fee lawyer first and then let the attorney go through the evidence and ask questions. Once this has been done the lawyer should be able to very clearly answer your question.
