Can change attorneys before I accept settlement if I feel the attorney didn’t do an effective job and only went to short settle?

You can change attorneys, however I would recommend that you counsel with your present attorney to determine why there were changes in their opinion over the prosecution of the case first. Then you could seek a second opinion if you desired.

What can we do if we are being sued for personal injury?

The agreement you signed with your friend will not help at all in the lawsuit by the girl's mother. As a partner you are completely liable for partnership liabilities. However, if you pay more than your agreed upon share based on the limitation of liability agreement, you can get that amount back from your partner. Have you submitted claim to your insurance? This is why partnerships are not best business form. If your business was incorporated you would have no personal liability at all.

What are the standard terms for distribution of funds for an accident?

David F. Stoddard

Most attorneys get 1/3 or the gross. Some take 1/3 of the net after costs are taken out . In all cases, the attorney reimburses himself for the costs of the case. The only difference is whether the attorney computes the 1/3 after reimbursing the costs or before. Contingency fee retainers are required to be in writing, and the rule that requires them to be in writing require that the agreement specify whether the percentage is applied to the gross recovery or the net recovery.
