It's not personal injury unless you were personally injured. You have a property damage claim. Submit the claim to your homeowner's insurance carrier and they will recoup their costs from the driver. If you don't have insurance or don't want to involve your insurance, you can submit a claim directly to the driver's insurance company. Either way, insurance will cover it. To be safe, speak with an attorney about it.

Yes, you'd need to go to the police and let them know what happened, and that you lied because you were afraid of him (or explain why you lied). Good luck. You may also have the right to file a Petition for Domestic Abuse Protection.

A driver buys insurance to protect against claims from their negligence. Do not settle quickly because once you settle you cannot go back a second time for money. Medicare won't pay a dime for auto injury by law. If they paid, you have to pay them back. You need a lawyer especially with pre existing conditions.
