You can sue the broker for negligence for his failure to procure an automobile insurance policy for you after you had provided him with all the required information. His negligence consisted of failing to send the company a clear copy of your driver's license when requested. The broker should have requested you to let him again fax the license to the company. Also, you have a case for misrepresentation when he sent the check back to the company and then told you that everything was fine and that you had insurance. The broker or insurance company should cover your damages.

Your auto policy should have uninsured motorist coverage unless you went for the lowest legal limit and waive UI coverage. If you did, you are self-insured or try your health insurance.
