That is what is fair, repaying some of the loss. Now, as to the worth of your claim for pain and suffering that is based on the way the accident happened, the amo0unt of property damage, your injuries, your medical care, the doctors opinions, the amount of the bills, the amount of your wage loss (proved). If you have a good case see a good lawyer and he will try to get you a reasonable settlement.

If you are on "temporary and total disability" you can claim no more than 2/3 of your average weekly earnings up to a maximum of $916.33 per week if the date of injury was in 2008, for example. If you are on "permanent and partial disability" then you can claim between $230 to $270 per week. if your date of injury, for example, was in 2006. No, you cannot get lost wages per se but you can claim disability per above answer. As for stress, if the stress has produced a mental injury and produced disability, then you can claim the above amounts. Good luck.
