No, it is not too late. You should speak with an attorney soon to discuss how you are going to prove your pain and suffering without the follow up medical care.

Can I sue someone who damaged my property one year ago?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)

Yes, the statute of limitations for both negligence and intentional acts in Florida is 4 years. Be prepared to have your witnesses testify, though. If the damages are under $5,000 you can do it yourself in small claims court.

Is it too late to sue for more claims on an accident that happened five years ago?

Answered by attorney Jami S. Oliver
Personal Injury lawyer at Oliver Law Office
Ohio has a two year statute of limitations for auto accident claims. Sometimes that may be "tolled;" for instance, if the at-fault driver or "tortfeasor" is in prison or out of the jurisdiction for a period of time. However, without something like that to extend the two-year time period, you are probably out of luck.
