In Michigan you collect workers compensation from your employer/their insurer for your wage loss and they pay for your medical care and treatment that is on the job injury related. If there was an individual/company, other than a co-employee/employer, responsible for negligently repairing/altering the machine that caused you injury you may have a case against them (3rd party case), but these can be expensive to present and your damages would have to be sufficient to allow such a claim to be pursued. Further, such a case will have a lien on it re any work comp benefits paid to you (so any recovery $ must be sufficient to cover the costs, pay the lien, pay you and pay your attorney).

#1 Ask your Georgia Attorney. He/she knows your case & would be able to correctly answer the question. If you don't trust your lawyer, you do have the right to change attorneys. #2 The answer in most (but not all) instances is YES; Georgia workers compensation judges usually require injured employees to come to court in Georgia. The thinking is: "you are bringing a Georgia claim & we can require you to come to Georgia to get favorable action relating to that claim."

You can always sue.  However, in this instance, your damages are very limited, and you are going to be hard pressed to find an attorney to handle this matter for you.  The good news is, no additional damages came about.  Unfortunately, more severe damages are typically required before you can have a viable legal claim.
