So, is it now inoperable? Or can it still be operated on? Have you suffered only long term injury or will the operation take care of it? Has your tumor grown significantly in the last 8 months? Did the doctor use the care that another orthopedist would use in your area? If the end result would not be different if it had been discovered earlier, there is not much for you to recover. Regardless, you need to talk with an attorney that specializes in medical malpractice to ask you all of the right questions.

This is a VERY complex legal matter. The issues of what state's laws apply and where you would bring such a lawsuit are not simple. You need a lawyer for this right away the lawyer's fee will be pocket change compared to the benefit his services will give you. Assuming Michigan law applies, the issue of your lost wages is separate from the issue of your pain and suffering. If your pain will not resolve, you may need back surgery. It would be legal malpractice to settle this case before we know how your injuries develop and Michigan has a 3 year statute of limitations for bringing an action against the other driver.

Michigan has a 2 year statute of limitations for medical malpractice. However the statute has a # of requirements that have to be fulfilled before suing. You would need to consult a Michigan lawyer who regularly handles medical malpractice cases to be able to fulfill all the requirements, as well as to determine whether you have a case.
