Will a personal injury attorney let your borrow money on a personal injury case?

Howard Dale Mishkind
Answered by attorney Howard Dale Mishkind (Unclaimed Profile)
Personal Injury lawyer at Mishkind Law Firm, Co., L.P.A.
No. The attorney is prohibited from loaning money to a client even if it is for a short period of time and will be paid back from the pending settlement. The Rules of Professional conduct prohibit this. You might be able to contact(with the assistance from your attorney) a settlement company that does make advances(at a high interest rate) on settlements.

Is the Home Owner liable for an injury if the licensed contractor is injured and is exempt from worker’s compensation?

B. Casey Yim
Answered by attorney B. Casey Yim (Unclaimed Profile)
Personal Injury lawyer at Murchison & Cumming, LLP
As owner of the contracting company you probably don't qualify for w comp coverage. I'm sure your contract makes you as contractor responsible for complying w all applicable laws, including WC for your employees. There is also probably an indemnity clause requiring you to indemnify homeowner from WC claims by your employees. If you are injured by your own fault, w/ no negligence by home owner, the home owner cannot possibly be liable for your injuries. WC won't apply because you are an independent contractor, not an employee of home owner. If you are WC exempt, that's your own voluntary choice, making you non covered by WC even as an employee of your own company.

Can I file a lawsuit against my doctor for misdiagnosis?

Paul L. Whitfield

You have a medical question. I doubt if you can blame the dr for pain but you must get your entire chart and let a medical dr review it, then ask him.
