Yes you can be charged and yes you can be convicted. Most likely, you will be. You can never injure a person in defense of property. The law believes that people are more valuable than material things. Good luck.

Any remedy you have is covered by Workers' Compensation, assuming you are an employee and your employer has paid for workers' compensation as is required by law. If you are indeed covered by Workers' Compensation, you cannot file a lawsuit in court.

In Texas you can't "settle" work comp unless it was an injury 1989 or before. If you received work comp benefits they are not taxable, do not get reported to the IRS or Social Security, etc.. If you received a settlement of a personal injury lawsuit then to the extent that you are on Medicare/Medicaid, some of that money may have to paid or set aside for future medical. This is something that you MUST talk to your attorney about.
