I felt it took to long to get a lawsuit dismissed. It took over 2 years....and the person suing me was not able to provide any discovery.
Heyl, Royster was retained to perform an eviction at 1015 E Willcox in Peoria. After the eviction on July 15, 2024, I hired Handyman (H) to prepare property for sale. The work performed was faulty and I refused to pay the amount requested as there was no contract, the amount was more than twice the number verbally agreed and the work was poor. I paid $5,713 to repair the work. I was fined $1,349 by the city due to debris left in the alley and failure to remove the debris despite the fact that I was billed for cleanup. I paid $6,407.38 to H even though I was told that the total would be $10,000 and I paid more than that. (H charged my credit card without permission.) H owed me $3,469.38. Despite that H had no valid claim and the Mechanics lien was improperly perfected, Heyl Royster sued my entity and obtained a default judgment without serving me. They foreclosed on my home yesterday and I paid $56,274.52 to get it back. $36,670 went to Heyl Royster. Tyler Smith should be disbarred.
