What can I do if my husband is refusing to go ahead with the immigration paperwork?

As long as you can show your marriage is not for immigration purposes, CIS may approve your i-485. The problem is that without his participation, CIS will question the bona fides of your marriage.

You will need to meet with an attorney with detailed information about the arrest. It will depend on the state criminal statute.

Is there a way to keep my fiance here when his green card expires without being forced to get married so soon?

The delay in your fiance's approval for naturalization does not mean that he is in trouble; sometimes, these delays have little to do with the substance of the case; and, in any event, expiration of his green card while his naturalization application is pending does not, in itself, render him deportable. Besides, if his naturalization is hindered by some "little trouble" in his past that turns out a bit more serious than you thought, a marriage to a U.S. citizen might not save him. One way or another, it appears that your fiance should speak with an immigration attorney to evaluate the case and decide whether anything should be done - while there is time to do it.
