Can I apply for a K-4 visa without having to apply for a K-3 visa?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
If it's only your child, then K-4 is not an option for him. In order to have a dependant visa like K-4, the person should have the main applicant who, in your case, is missing.

Can consulate require a cosponsor when current income is more than 2 times poverty guidelines?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
If a consular official has a reasonable belief, even if unsubstantiated, that you or your beneficiary are disqualified, then the State Department can demand more evidence. Currently, there is a good chance that she was tentatively denied based upon INA Section 221(g). You really need to decide whether you can afford an competent and experienced attorney, let alone, petition your wife. You will likely need a joint sponsor. There may be other unmentioned complications Good luck.
