You are not eligible for another 6 years of H-1B unless you leave the country for a full year (just going back to school in the U.S. does not give you another 6 years) or begin the green card process with an employer and get an approved I-140.

Generally, yes, he can still process. However, some USCIS districts are no longer permitting Adjustments/green cards based on marriage when you overstay a Visa Waiver. Thus, he/you should be very careful to verify this.
