Can I petition to have my wife and 2 step children come to the US?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
As an LPR, you are able to petition for wife and step children. However it will be years until they are able to enter the US, if you married after you became an LPR. My recommendation is to file now, while the kids are under 18. Then become a US citizen as soon as you can. At that point, if their case is still waiting under the quota system, you can upgrade their cases to immediate relatives. For a full review of consular processing, please visit my website.

What does petty theft exemption means if you were precluded in good moral character with petty theft charges against you?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
You need to show 5 years of good moral character at the time you file for naturalization. Your recent petty theft charge will wipe that out. Therefore, you will have to wait another 5 years from the date of your conviction or plea before filing for naturalization again.

An i apply for a citizenship after 3 years of being permanent resident ?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hi. If your wife is not a citizen, then you must wait 5 years of Residency(LPR/Green card) until you can apply for your naturalization. Unless, you are under 18. You can apply 90 days before your 5 year anniversary.
