Can I lose my conditional green card that my step mother petitioned for if I no longer talk to her?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
If you have a two year green card, that means you are a derivative of your mother, and that she was the principal applicant via marriage to a US citizen husband. You will need to apply for permanent residency in the ninety day window before your residency card expires. You should be able to do this without residing with your mother.

How do I go about marrying my Australian fiancé in Australia and bring her back here in the US?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally, a U.S. citizen who becomes married abroad to a foreign national may sponsor the foreign national spouse to become a Lawful Permanent Resident through "consular processing." Alternatively, the couple could apply for a fiancee visa that would allow the foreign national to enter the U.S. for the purpose of becoming married within the required time and then applying here to "adjust status" to become a Permanent Resident. There are many additional issues that address eligibility for consular processing and/or for adjustment of status, and additional considerations about advantages and disadvantages for each approach. It would be wise for you and your fiancee to consult with an immigration attorney who, after learning all of the relevant information about each of you and about your goals, would be able to advise you about eligibilities, options and strategies and offer legal representation in the application process.

Can I fix my fiances papers?

default-avatar
Answered by attorney Patrick Lee Jarrett (Unclaimed Profile)
Immigration lawyer at Jarrett & Price, LLC
It is not clear what you mean by "fix" your fiance's papers. Depending on how she entered the country and her current status, you may be able to petition for her after you have married. More information is needed to give any advice.
