I am on ssdi and would like to move my Philippine girlfriend to the us to live with me and get married. How could i do this? Please help me

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I assume that you are a US citizen. If so, the two best choices are to sponsor your girlfriend and her child to come to the US on a K-1 fiancée visa, or to marry her and sponsor her for the green card directly. For the K-1 visa sponsorship, you must prove that you have met each other physically during the past two years. K-1 visa petitions are initiated on form I-129F and green card applications on form I-130. For either one, you will ultimately have to prove that you have the ability to support your girlfriend and her child either through yourself or with the assistance of a financial cosponsor. Can an immigrant parent with sole custody of an American citizen child be able to apply for a green card?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Unfortunately, the only way to immigrate would be for your child to petition you once your child reaches the age of 21. Having a U.S. citizen child under the age of 21 alone is not enough.

My boyfriend is Guatemalan with no status in the USA, if we marry will he be deported?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
He will not be deported fro marrying a US citizen. However, depending on his immigration and other background history, he may be eligible to obtain permanent residence (green card). You should consult an experienced immigration lawyer for that matter.
