Is it better to file for a green card while married or after the divorce?

Answered by attorney William D. Fong (Unclaimed Profile)
Immigration lawyer at Fong Ilagan
The decision to divorce should be unrelated to the underlying immigration case. If she divorces now, she can file the I-751 on her own based on "good faith" marriage ended in divorce. She needs to have evidence of cohabitation and co-mingling of funds. you.

Can a cosponsor file I486 if their income well exceeds poverty guidelines?

Answered by attorney Marie Andree Michaud (Unclaimed Profile)
Immigration lawyer at Marie Michaud, Attorney At Law
I am assuming you mean I-864, the affidavit of support. As long as the income is above the poverty guidelines + 25% (See on USCIS Form I-864P), you satisfy the requirement as to the income level.

Can I renew my green card if my husband is in jail?

default-avatar
Answered by attorney Josue Soncuya Villanueva (Unclaimed Profile)
Immigration lawyer at Law Office of Josue S. Villanueva
Is your status conditional? If so, you do not renew your green card. You remove the condition. I am assuming your husband is a USC. If so, he can stay in jail for as long as he wants to and not worry getting deported. That is one of the privileges of being a US citizen.
