I am reluctant to answer without further clarification. However, if I understand your facts correctly, if the processing time on your I-485 has passed, you can sue the USCIS in Federal court and they will process your application timely but if it is within the processing time, I think you should wait. We need more information about the status of your waiver. Normally, if someone has been out of status and applies for Advance parole, the AP is denied.

Eventually, an immigration officer may tell him that he's here to much and that he needs to get a visa issued. Some people get away with entry that way for many years, but at any time, the officers at the airport can say that's enough, and not let him in. It's very arbitrary and unpredictable.

You can and should take your child with you. You should obtain all proper documentation i.e., birth certificate and passports prior to leaving the US.
