Unless you marry her or plan to marry her within 90 days of her entering the U.S. (Fiance visa), there is no way for her to come to the U.S. permanently and obtain work authorization.

Can I get my green card back after being voluntarily deported?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Since you have already been sent overseas we will need to re-apply for your permanent residency - you may or may not have been eligible for LPR cancellation of removal but it is too late now. We will need to see the documents relating to your "voluntary deportation" (probably either voluntary departure or deportation) as a misdemeanor theft would not normally result in this. We will need to re-apply for your permanent residency through your marriage and I would anticipate the process taking 7-12 months. I would be happy to consult with you on your case. I do charge for consultations but whatever is paid for the consultation would be a credit toward the fees for your case if you retain us for further work after the consult. The consultation can be scheduled as indicated below by contacting my secretary.

Is marrying to continue a shared life considered fraud?

Answered by attorney Lana Vladimirovna Kurilova Rich (Unclaimed Profile)
Immigration lawyer at Lana Kurilova Rich PLLC
You are not required to have a celebration, a wedding. So long as you are legally married in good faith, there is no marriage fraud. If you decide to later have a fancy wedding ceremony, that is your choice but not a legal requirement. The key is to be legally married in good faith. If you are in love and plan to spend a lifetime together, there is nothing wrong with having a simple civil ceremony.
