Can I get a green card even if I have some charges?

Answered by attorney Ross Elliott Miller (Unclaimed Profile)
Immigration lawyer at Miller Conway
The commission of certain crimes could cause an applicant to be ineligible for naturalization. However, shoplifting, theft and possession of alcohol alone will not bar you from receiving a green card (assuming the charges are not felonies). That said, three (3) separate charges could be a problem as you could be viewed as a habitual offender. As the charges are still pending I recommend contacting a law firm or attorney that handles criminal and/or immigration cases.

Do I need to refile a B2 visa application if I'm married to a US citizen?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Since July 30 was 2 weeks ago, you are already out of status and cannot apply for an extension. Leaving the U.S. and trying to come back on another B2 or on a visa waiver can be difficult because you overstayed your admission this time (since you did not yet stay here 180 or more after your admission expired, you are not yet subject to a 3-year bar; but U.S. Consul can deny you a visa and the Border Protection can deny you entry on a visa waiver) On the other hand, once you entered legally and then became married to a U.S. citizen, the time you spend in the U.S. out of status does not affect your ability to adjust status to an LPR. So you can refile any time. I would, however, suggest that you re-file as soon as possible - for quite a few reasons. If your husband does not have income now, he can ask a friend or a relative to file a second affidavit of support as a co-sponsor.

What are my options to return after I was deported in 2010?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. What were you convicted of? Depending on the conviction, you may be inadmissible and will not be granted entry into the U.S. I strongly suggest that a family member contact an experienced immigration defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case and advise you of your options.
