Can my wife take my green card back?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Since your status is conditional, you will need to remove your conditions during the 90 period before the 2 years expires. If you divorce, you can still file alone and without her support. You would have a good case since you have children together. They will not just come and take your green card. You will have your opportunity to prove the marriage was real, but you had problems and divorced (eventually).

I was convicted with a drug charge and then got a second drug charge what will happen to my future in American in general?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Before the commission of the first crime, if you were a person who was lawfully admitted for permanent residence for not less than five years, and had resided in the United States continuously for seven years after having been admitted in any status, you would likely be eligible for cancellation of removal for permanent residents. On the other hand, if you were not in those circumstances, you would have a much more difficult path to keep your permanent residence if placed under removal proceedings. You would likely have to have the Xanax pill conviction overturned. With the arrest for possession of marijuana and paraphernalia, you would not be deportable on the charge if it related to 30 g of marijuana or less. If not, you would have to have avoid conviction on the charge if the case is still going on. If already convicted, you would have to have the conviction overturned.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. If I just found my I 94 expired but still have valid visa till month end and I am leaving the country this month end, should I still extend my I 94?

Answered by attorney Mary Lyn Tanawan Sanga (Unclaimed Profile)
Immigration lawyer at Law Offices of Mary Lyn T. Sanga A Professional Corporation
No, you cannot apply for extension of your stay if your I-94 has already expired. The validity period in your I-94 determines the period of authorized stay. The validity period in your visa stamp determines the period you can travel to and enter the United States using that visa.
