Yes. In order to qualify for naturalization, you must have at least 5 years of good moral conduct, which means no criminal convictions or pending charges. In addition, depending on what the criminal charges are, you may be removable/deportable based on the charges even if you presently have a green card or found inadmissible, all of which could affect your naturalization. I strongly suggest that you contact an experienced criminal law attorney and an immigration attorney for a face-to-face consultation and give them all of the facts surrounding your arrest. They would then be in a better position to analyze your case and advise you of your options.

As long as you have proof of lawful entry, he can petition you and you do not have to leave. He has to file an I-130 petition (family petition) in conjunction with an I-485 (adjustment form). The process is about 6 months and you can get a work authorization in 2 months.
