Whether you worked or not will not affect you. Just tell the truth. However I see another problem with your case. You said you came to the US in 2002 and your priority date is 04/19/2001. If a petition that your claim 245i from is filed after 1998 you must show that you were physically present in the US in December 2000. I am not sure whether your attorney has looked in to it or not.
