I am assuming that you are overseas and attempting to enter the U.S. in order to take care of your girlfriend. If your girlfriend is a U.S. citizen, divorced from her ex-husband and you are both contemplating marriage, she could file for a fiance visa on your behalf. You would then have to get married within 90 days of entering the U.S.

Yes. You can still submit your I-765 application separately at this stage of the process. The application should go to the same USCIS address in Chicago that you sent your I-485 application to. There is no fee for the application if you have applied for adjustment of status. Just remember to include a copy of your I-485 fee receipt with your application.

I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case, advise you of your options and make sure that the necessary paperwork and documentation is presented so as not to delay the process.
