Can my mother apply for me again if she is a green card holder?

Hassan Hussein Elkhalil
Answered by attorney Hassan Hussein Elkhalil (Unclaimed Profile)
Immigration lawyer at Elkhalil Law, P.C.
Yes you can file another application through your mother. It will be shorter time if you file a family petition through your mother. Once your visa is available, you would have to withdraw the other pending application; the one filed through your brother in this case.

Immigration

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
That depends on the actual statute you would be pleading to and its related punishment scheme.  Your lawyer to consult with an immigration attorney to properly advise you about the immigration consequences of your plea.  Your case will require individual analysis.

Can I apply for visa and not be denied, because I’m not in system?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)

If you overstayed by more than one year and left the US, you have triggered a ten year bar. You are eligible to enter after that time, or in certain cases, can file for an immigrant or non immigrant waiver before that.
