How do I get my boyfriend back to America?

Hassan Hussein Elkhalil
Answered by attorney Hassan Hussein Elkhalil (Unclaimed Profile)
Immigration lawyer at Elkhalil Law, P.C.
As a first step, consult with an immigration attorney. As to the overstay, because he overstayed more than one year, he is not eligible to come back for ten years. However, if you get married and file immediate family petition, he can file for a waiver and still immigrate to the U.S. If you do not want to get married now, you can file fiance visa and you have to marry within 90 days from his time of entry to the U.S.

You may be able to petition for your step son. You should consult with an immigration attorney to understand that process.

Who processes immigration visa to come to USA

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Their is no "friend" visa category that you can sponsor him under. He can be sponsored by a US citizen fiancé, or he can get married to a US citizen or green card holder and be sponsored under those conditions. If he has a job offer, then his employer can sponsor him. There are other ways through investment visas etc, but those are restricted based on whether the country that he is residing in his part of the treaty.
