A U.S. Citizen adult child may petition for a parent in the Immediate Relative visa category, and a salary of $65,000/year is more than enough to meet the Affidavit of Support eligibility requirements for a petitioner who is single. If the beneficiary (your mother) has not lawfully changed her name following her divorce, then she should use her actual legal name (e.g. with her former husband's surname). Both the USCIS (if your mother now is in the U.S.) and consulate offices (if your mother is overseas) generally are accommodating to people with disabilities. More details about your mother's current disability may be needed in order to assess whether her limitations may be problematic in the application process and in assessing steps to deal with those complications. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

It is taking far too long. Because you are a US Citizen, you should be able do the I-130 and then the Consulate processing. Alternatively, if you have received a receipt notice, you could do the K3 Petition. *K3 Petition* Since you are already married and your spouse is outside the U.S., it would be necessary to apply for the K-3 Visa. The particular visa is considerably faster than the Consulate Processing needed to bring your spouse in as a Lawful Permanent Resident. Here, we would apply for the K-3 Visa which would take about 6 months. After, your spouse is in the U.S., the Adjustment of Status package can be filed.

It will take years for the visa number to become current on a PERM. He should apply for the H-1B first. *H-1B Specialty Occupation Visa* You qualify for what is known as the H-1B Specialty Occupation Visa. You will need to have an employer agree to sponsor you for a job. It does not need to be a full-time position, but it should be related to your degree. Our firm can do the entire petition. Once we begin processing and get it filed, it normally takes about six to nine months to get the approval. Please note that H-1B's are very limited and are only available for small periods of time during the year. Therefore, Premium Processing discussed next should be used. If you want a work permit in an expedited manner, you can take advantage of the Premium Processing program at USCIS. This will allow you to have the expedited answer in less than one month. You will need to add $1,500.00 to the cost below for Premium Processing. There are only a limited number of H-1B's and it must be filed by April 1. However, it is still possible it will not get selected for this years allotment.
