Make an appointment with a competent immigration attorney right now. If you don't know one, try aila and look for someone in your region. Also most state bars have low income panels if you do not have a lot of money. This person needs to specialize in removal proceedings. He or she can fully analyze his case to see if there is anything to be done and if he has any rights to remain in the US.

How long do I have to stay married to maintain the green card as a spouse of GC Lottery winner?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Since your green card is a 10-year one, it is not conditioned on your continued marital relationship to the principal beneficiary of the underlying application. (Just to make sure, look at the code on your green card if it does not say CR6, rest easy). So the divorce would not jeopardize your LPR status. And I do not think any claims that the marriage was not a real one would fly with USCIS, if for no other reason, then because you married your husband years before he even applied for a diversity lottery visa.

How long does it take to petition my brother?

Answered by attorney Eric Arden Fisher (Unclaimed Profile)
Immigration lawyer at The Law Office of Eric A. Fisher, LLC
If you file the I-130 petition now, you should get a decision within 6 months, but your brother will not be able to apply for n immigrant visa for almost 12 years. That is how long the preference category for brothers of a USC (F4) is backed up.
