Do I need to file an immigration extension even though I'm already married?

Answered by attorney Richard Stephan Kolomejec (Unclaimed Profile)

I don't think that you need to do the extension. Your wife should become a US citizen within next month or two and then can apply for your green card. If your status expires, there is no penalty for filing late. So I would save your money for the green card process. And waiting for your wife to become a US citizen is not a good enough reason to file for an extension of your tourist visa anyways.

Can my son petition for us when he becomes a citizen even if we have overstayed in the US?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
Once your son is a U.S. Citizen he can petition you. If you legally entered the U.S. and were admitted and inspected you can apply for adjustment of status in the U.S. even if you overstayed if filing based on your son's petition.

Can we use the same petition to get citizenship?

Immigration lawyer at Verdin Law
You need an approved petition to complete the adjustment of status. You may consider filing a new petition, or investigating whether the first petition was ultimately denied for abandonment.
