What are my chances of getting my citizenship after this arrest nightmare?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Sorry to learn of the abuse you suffered. The impact of an arrest for domestic violence on naturalization eligibility (as well as on other immigration eligibilities) can be significantly more complex than it might appear. Some criminal offenses that a statute identifies as a misdemeanor can be treated as a felony by the USCIS, and some dispositions that do not include a criminal conviction can be treated as a criminal conviction by the USCIS. Generally, however, an arrest that becomes dismissed without a conviction will not stand in the way of naturalization eligibility, although it will be necessary in the application process to reveal the arrest (the USCIS will know about it anyway through its security background checks), and a full set of court-certified copies of the disposition documents will need to be supplied to the USCIS. It would be wise for you to consult with an immigration attorney, who, after learning all of the relevant facts about the 2012 arrest and its disposition (including review of the disposition documents), will be able to advise you about eligibility and to offer legal representation to you in the naturalization application process.

Do I have a US residency if I was born in the US?

Immigration lawyer at Havens Lichtenberg PLLC
If you were born in the U.S. and have a U.S. birth certificate, you are a U.S. citizen. Within 6 months after your 18th birthday, you should register your claim of U.S. citizenship with a U.S. Consulate or Embassy in your country. You should also avoid service in the armed forces of your country by stating your U.S. citizenship (otherwise, you can lose it). Make an appointment with the U.S. consul, and ask for a U.S. passport.
