How can my mother claim her pension?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
There seem to be several sides to your question: first, the surviving spouse benefits for your mother on your father's veterans' pension (and, possibly, on his Social Security pension); second, proving that your father was a U.S. citizen; third, sorting out your own status in the U.S., including employment authorization. It is impossible to answer any of these questions without more information than you provided. It is likely that the archives will have to be searched for the documents which you don't have, but what you do have is necessary to get the case started. Call the Bar Association in the county where you live and ask for a referral to an attorney who handles retirement benefits cases and immigration law cases.

Should I send my passport to USCIS when filing for TN visa extension with 1-129?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
When filing for a TN visa extension with USCIS, only a copy of the passport is required. Please note that USCIS does not do anything with the passport and only issues an I-797 s notice of approval if it decides to favorably adjudicate the TN extension request. If you travel outside the US, you will still have to pass inspection with Customs and Border Protection when you reenter the US in which the officer will take a look anew at the merits of your request for TN extension.
