If I travel to Mexico on January 6,2016 by cruise ship right after I submit the I-539, does that mean my I-539 application is abandoned automatically?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
Yes. You should not be traveling outside the US on a cruise ship, by plane, car or by any other means (if you would like your I 539 to remain pending).

What happens in a petition if the sponsor does not have an income?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
This is a bit more complicated. Sometimes, more than one joint sponsor is necessary. It's also important to include all the necessary documents and be aware that you are financially responsible and can be sued if the person who is sponsored requires/demands support or becomes a public charge and thereafter goes on welfare. The joint sponsor, as well as a sponsor, becomes legally bound to an agreement with both the Government and the Immigrant to financially support the immigrant at the rate indicated in the agreement for up to ten years or until the immigrant decides to apply, pass the test, qualify and take the oath of Citizenship at a ceremony. I strongly recommend an appointment with a competent and experienced immigration attorney. If you cannot afford one, then reconsider the possible consequences and costs of signing this agreement.

How do I go about it and what kind of evidence do I put together to prove it's a bona fide marriage?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
The USCIS repeatedly has expressed its position that the appropriate documents to be supplied as evidence of the bona fide nature of a couple's marital relationship must be determined on a case-by-case basis, according to the circumstances of the couple. Nonetheless, in general the most persuasive evidence includes: a child's birth certificate identifying both persons as parents; documents showing the couple has "put their financial lives together," such as bank statements from a joint bank account into which both persons deposit their earnings and from which the household expenses are paid; residential leases or home deeds in both spouses' names; tax returns; utility bills and other documents from third parties; photographs of the couple together with other family members; etc. There really is no substitute for working with an immigration attorney who, after learning all of the relevant information about you, your husband, your marriage, etc. would be able to advise you about the most appropriate supporting documentation to submit and would be able to offer legal representation to your family in the often quite complex application process.
