Would it be safe for me to visit US after a gap of 7 months or there might be a problem for me at POE because of the long stay on previous visit?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
You never know. Some people can do that for 15 years and never have a problem, and then you may try it for a third time and have a problem. Unfortunately, whether you get a problem at the POE is very arbitrary. Perhaps consulting with a board certified immigration lawyer like me would be a good idea at some point, so you could be aware of certain "red flag" issues.

How do we get a fiancee visa?

You must first file an I-129F petition with USCIS. After that is approved, the file goes to the National Visa Center where they will review it and instruct the US Consul in Manila to send your fiance a visa package. The use of an immigration attorney would help the process.

What will happen if I overstayed by 9 months and got married to USC before NTA?

It makes your case more complicated and can take much longer, but if your only violation of law is as an overstay, and if you are otherwise fully eligible, then most judges would normally approve the green card.
