First you need to be divorced. I find it is faster if the couple is married rather than fiance but each case is different. I recommend working with an attorney, my firm handles such cases in NY.

It's been ver two yrs since I past the test waiting to be sworn in . Until today no response. Sent out requests only get responses of in background ck

You appear to have been doing all of the things to track your case that any reasonable person would do. It is difficult to know what the problem is although many cases of delay can be attributable to background checks in which other persons who are of interest to law enforcement have a common name to yours. As it has already been over 2 years, you may consider the option of bringing suit against the agency in federal court. I note, however, that while such a suit may expedite consideration of your case, it will not assist you in obtaining ultimate naturalization if you are barred from naturalization under any ground of law. How long can I stay in US while my I539 is pending?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
You may remain while you are waiting for the decision, however it does not mean that you have a certain status. Consult with an attorney as to what you can and cannot do, etc.
