Your first step in getting your husband's residency would be to file an alien relative petition or I-130 petition for him. The new law you are referring to is called the provisional unlawful presence waiver. This waiver is only available to immediate relatives of  U.S citizens (spouses, children, parents), who are unlawfully present and are otherwise not eligible to adjust their status within the US. This process allows them to file for a waiver of inadmissibility in the US and receive a determination on the waiver before they leave the country to attend their immigrant consular interview. You can see generally USCIS.gov for more information On the waiver process.  There are various factors that make a person inadmissible as a permanent resident, such as certain crimes or even several illegal entries  to the United States, your husband will need a thorough review of his immigration and other legal history before anyone can determine whether or not he has a chance of becoming a permanent resident.
