There seems to be some confusion in your question: did you mean he has an immigration hold or was he imprisoned for an insurance fraud? I there is an immigration hold, it means that he will not be released, and the immigration authorities will start removal (deportation) proceedings. The outcome will depend on several factors: how long did your husband have a green card, how large was the fraud, what was the conviction (was it for insurance fraud or for some other charge), how long was the sentence, and what are your family circumstances (your health, age and health of the children, etc.) You should try to speak with an immigration attorney as soon as possible because, if there is anything that can be done, it will have to be done very quickly.

You cannot sponsor yourself on an I-864 unless you have income earned from within the United States. Either her daughter will have to sponsor her or she must find another person willing to sign the I-864 from within the United States.
