Do I need to change my last name for my husband to get his visa?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
You do not have to change your name. A K3 visa is not a good option, usually. A K1 or an I-130 are better options usually, depending on your situation and wishes for the wedding. Call me for a free consultation to evaluate your situation.

Trying to apply for husbands greencard i am a us citizen will the new waiver help us

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
You have possibilities of having the I-601A application for provisional waiver approved on the basis of extreme hardship to you if the waiver is not granted. Although only U.S.C.I.S. can make a decision, the little that you have mentioned sounds fairly compelling. I suggest that you find an attorney competent in I-601A filings. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. How long can i 751 proceed to remove permanent residency

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
Divorcing and re-filing won't help.  Just continue to wait for a response.  While the application is pending, you are allowed to stay in the US.  You just won't be able to travel outside the US.
