One petty theft on your record is usually not a big deal. And the possession of alcohol offense is rather minor. So I don't think that this will cause any problems for you when applying for your green card. Please get certified copies of the court disposition for both charges.

A person on visa waiver can marry a USA citizen, prepare and process the proper papers, and then stay here for the conclusion of the green card process, assuming they are otherwise qualified.

Citizenship law has changed over the years and different laws apply to determine whether you are automatically a U.S. citizen of not. Since you were born after 12/24/1952 but before 11/4/1986, the law effective at your time of birth applies, which would be INA section 301(a)(7) [now section 301(g)]. In order for your father's US citizenship to be transmitted, you will need to provide proof that your father was physically present in the U.S. 10 years prior to your birth, 5 of which after he turned 14 years old.
